1. This document sets out the principles for the processing of personal data and the use of cookies on the site Nogano Design ("Service") available at: https://noganodesign.com/

4. The service uses personal data for the following purposes: handling enquiries, presenting the offer, processing orders, sending mailings (newsletters, discounts, news, information on launches and offers), analytics and security of the Service.

2 Scope of data and sources

We process data:

• given directly (contact/subscription forms): name, email address, telephone (if you provide), company (if you provide), message content;

• automatically sourced: IP address, cookie/device identifiers, activity data, browser/device type, server logs;

• transactional: the data required to process orders, payments, deliveries and settlements.

3 Objectives and legal bases for processing

1. Mailing (newsletter/marketing communication): sending content about news, launches, discounts, offers, educational material.
   Basis: Consent (Article 6(1)(a) of the RODO). You can withdraw your consent at any time (link in the footer of each email).

2. Notifications and transactional communication: order confirmations, payments, deliveries, complaints.
   Basis: performance of a contract or pre-contractual action (Article 6(1)(b)) and a legal obligation (Article 6(1)(c)).

3. Handling of requests (form/e-mail/telephone): answers, preparation of offers.
   Basis: our legitimate interest in conducting correspondence (Article 6(1)(f)) or pre-contractual activities (Article 6(1)(b)).

4. Analytics, statistics, UX and security of the Service.
   Basis: necessary cookies and logs - legitimate interest (Article 6(1)(f)); analytics/marketing - consent (Article 6(1)(a)).

5. Own marketing beyond mailing (e.g. remarketing based on cookies - if you give your consent in the banner).
   Basis: consent (Article 6(1)(a)).

6. Establishment, exercise or defence of claims (evidential purposes).
   Basis: legitimate interest (Article 6(1)(f)).

4 Voluntary data provision

The provision of data is voluntary, but in some cases essential (e.g. e-mail for receiving mailings; delivery data for order processing).

5 Storage periods

• Mailing (newsletter/marketing): until you withdraw your consent or object.

• Server logs and cookies: in accordance with technical deadlines and/or until you delete or change your preferences in the CMP.

6 Data recipients (categories)

We may only entrust data to trusted entities processing it on our behalf:

• IT hosting and infrastructure: LH.pl Sp. z o.o., Poland;

• Mailing system: MailerLite (EU);

• Analytics/marketing: Google Analytics 4 (Google), Meta Pixel (Meta), Hotjar (EU);

• Payment operators/couriers;

• Accounting office, law firms, IT/marketing subcontractors - when necessary.
  We enter into entrustment of processing agreements (Article 28 RODO) with subjects, if required.

7 Transfers outside the EEA

The use of certain tools may involve the transfer of data outside the EEA. This is done in accordance with the RODO - based on adequacy decisions or Standard Contractual Clauses (SCC) and additional security features. Please refer to the policies of these providers for details.

8. Your rights

You have the right to: access to your data, rectification, erasure, restriction of processing, portability, to object (where the basis is Article 6(1)(f)), and to withdrawal of consent at any time (this does not affect the lawfulness of the processing before revocation).

9 Automated decisions and profiling

We do not take decisions with legal effect exclusively in an automated manner. As part of mailing and cookies, we may use segmentation and basic profiling (e.g. on the basis of opens, clicks, interest tags) in order to tailor content - without significant legal consequences for the User.

10 Safety

We use technical and organisational measures appropriate to the risk: TLS (HTTPS) encryption, access control, regular updates, backups, minimisation of data scope.

11 Forms on the Website

1. Forms can be used, among other things, for: contacting, signing up for mailing (newsletter/marketing communication, discounts, information on launches and offers), recruitment, event registration.

2. Each time we submit a form, we indicate purpose processing and scope of data required. 

3. The data from the forms are processed in the systems of the Administrator or its suppliers (e.g. MailerLite).

4. The basis for data processing is consent (Article 6(1)(a)) and, in the case of commercial enquiries, also legitimate interest or pre-contractual activities (Article 6(1)(f/b)).

12 Cookies and similar technologies

1. The website uses cookies and similar technologies. On your first visit, we display consent banner; you can accept/reject the cookie categories and change your choices at any time.

2. Types of cookies:

   • Essential - required for proper operation (session, security) - basis: Article 6(1)(f);

   • Analytical/statistical - measurement and optimisation of the Service - basis: consent;

   • Marketing - Personalisation of content/advertising, remarketing - basis: consent.

3. Cookie management: You can change your settings in the CMP or in your browser (restricting some cookies may make it more difficult to use the Website).

4. 13 Plug-ins, embedded content and external links

   The website may include plug-ins and external content (e.g. maps, fonts, videos). These entities may use their own cookies and process data in accordance with their own privacy policies.

   14 Public recipients

   Data may be shared with public authorities if required by law.

   15 Amendments to the Policy

   We reserve the right to amend the Policy; the new version will be published on the Website with the current date.
